1. Definitions
Photographer refers to Andrea Mariño Photography and any associated team members.
Client refers to the person(s) booking photography services.
Event refers to any wedding or related photography services, including photoshoots.
Agreement refers to the contract formed by these terms and conditions.
2. Booking and Payment
2.1 Retainer Fee
A non-refundable retainer fee of 50% is required to secure the date. The booking is not confirmed until this fee is received.
2.2 Final Payment
The remaining balance is due 30 days prior to wedding coverage and 7 days prior to photoshoots. Failure to pay on time may result in the cancellation of services.
2.3 Payment Methods
Accepted payment methods include bank transfer, PayPal, and cash. Please note that any additional bank fees (including those from bank transfers or PayPal) must be covered by you.
3. Cancellation and Rescheduling
3.1 Client Cancellation
If the Client cancels the booking, the retainer fee will not be refunded. Cancellations made within 15 days of the Event require full payment of the remaining balance.
3.2 Rescheduling
Requests to reschedule must be made in writing and are subject to the Photographer’s availability. If the Photographer is available for the new date, a new retainer fee will be required. If unavailable, the original retainer fee will not be refunded.
3.3 Photographer Cancellation
In the unlikely event the Photographer must cancel, all payments will be refunded in full, or a suitable replacement photographer will be arranged with the Client’s consent.
4. Services
4.1 Photography Coverage
Services will be provided as outlined in the agreed contract. Additional hours or services requested after the contract is signed will incur extra charges. These must be agreed upon in writing.
4.2 Artistic Style
The Client acknowledges familiarity with the Photographer’s portfolio and style and agrees to allow full artistic control during the Event and throughout post-production.
4.3 Timeliness and Additional Time
Any delays caused by the Client or external factors may result in forfeited coverage. Additional coverage may be requested at the following rates, subject to the Photographer’s availability:
*€300 per additional hour for wedding coverage
*€150 for an extra 30 minutes during photoshoots
Requests for additional time must be confirmed in writing and paid in full before image delivery.
5. Delivery
5.1 Image Processing
Images will be delivered as high-resolution JPGs with the Photographer’s signature color correction style. RAW files are not provided.
5.2 Delivery Timelines
Weddings: Delivery within 4–8 weeks after the wedding date.
Photoshoots: Delivery within 3–6 weeks after the photoshoot.
5.3 Delivery Method
Images will be provided via an online gallery.
5.4 Storage
Images will be stored for one year after delivery. Clients are responsible for backing up their images.
6. Copyright and Usage
6.1 Copyright
The Photographer retains full copyright over all images.
6.2 Client Usage
Clients are granted a license for personal use, including printing and social media sharing, with credit to Andrea Mariño Photography. Commercial use is prohibited without prior written consent.
6.3 Model Release and Promotional Use
By booking services, the Client grants permission for the Photographer to use images for promotional purposes, such as the Photographer’s website, social media, and portfolio. If the Client wishes to opt out, they must notify the Photographer in writing before the Event. An additional fee of 10% of the final price will be applied in such cases. This fee compensates for the inability to showcase recent work, which is essential for business growth.
This fee does not apply to images of landscapes, details, or decor, which may be used at the Photographer’s discretion.
7. Limitations of Liability
7.1 The Photographer will make reasonable efforts to deliver high-quality images but is not liable for circumstances beyond their control, such as equipment failure, weather conditions, or unforeseen incidents.
7.2 The Photographer’s liability is limited to the amount paid by the Client.
8. Dispute Resolution
In the event of a dispute, both parties agree to resolve the matter through mediation, in accordance with ICC (International Chamber of Commerce) Mediation Rules. Mediation will take place in Toulouse, France, and will be conducted in French. No judicial or arbitration proceedings may be initiated until mediation has concluded.
9. Force Majeure
The Photographer is not responsible for failure to perform due to circumstances beyond their control, including natural disasters, pandemics, or other emergencies. Efforts will be made to reschedule or refund payments where possible.
10. Agreement
By booking Andrea Mariño Photography, the Client acknowledges that they have read, understood, and agreed to these terms and conditions. Any changes to this Agreement must be made in writing and signed by both parties.
