Welcome to Andrea Mariño Photography. By booking my photography services, you agree to the following terms and conditions. Please read them carefully before confirming your booking.
1. Definitions
"Photographer" refers to Andrea Mariño Photography and any associated team members.
"Client" refers to the person(s) booking the photography services.
"Event" refers to any wedding or related photography services, including photoshoots.
"Agreement" refers to the contract formed by these terms and conditions.
2. Booking and Payment
2.1 Retainer Fee: A non-refundable retainer fee of 50 percent is required to secure your date. The booking is not confirmed until this fee is received.
2.2 Final Payment: The remaining balance is due 30 days prior for wedding coverages and 7 days prior to the photoshoot for photoshoot services. Failure to pay the balance on time may result in cancellation of services.
2.3 Payment Methods: Accepted methods of payment include: bank transfer, PayPal and/or cash.
3. Cancellation and Rescheduling
3.1 Client Cancellation: If the Client cancels the booking, the retainer fee will not be refunded. Cancellations made within 15 days of the Event require full payment of the remaining balance.
3.2 Rescheduling: Requests to reschedule the Event must be made in writing and are subject to the Photographer's availability. If the Photographer is available for the new date, a new retainer fee will be required to secure the new booking. If the Photographer is unavailable for the new date, the original retainer fee will not be refunded.
3.3 Photographer Cancellation: In the unlikely event the Photographer must cancel, a full refund of all payments made will be issued, or a suitable replacement photographer will be arranged with the Client’s consent.
4. Services
4.1 Photography Coverage: The Photographer will provide services as outlined in the agreed contract. Any additional hours and/or services requested after the signing of the contract will incur extra charges. Such additional hours and/or services must be agreed upon in writing and included in a new contract, which must be signed by both parties before the Event.
4.2 Artistic Style: The Client acknowledges that they are familiar with the Photographer’s portfolio and style and agrees to allow the Photographer full artistic control during the Event or photoshoot and throughout the post-production process.
4.3 Timeliness and Additional Time: Once the schedule and timings for the Event or photoshoot are confirmed, any delays caused by the Client, external reasons, or late arrival may result in forfeited coverage from the original timings. Depending on the Photographer’s availability, the Client may request additional time to extend the coverage or photoshoot length at the following rates: €300 per hour for wedding coverage and €150 for 30 extra minutes during a photoshoot. These requests must be agreed upon in writing (via email) by the Client. The invoice for the additional time must be paid in full before any previews and/or the final gallery are delivered.
5. Delivery
5.1 Image Processing: The Photographer will deliver high-resolution JPG images edited with its signature color correction style. RAW files are not delivered under any circumstances.
5.2 Delivery Timelines: For weddings, images will be delivered within 4-8 weeks after the wedding day has concluded. For photoshoots, images will be delivered within 3-6 weeks after the photoshoot has taken place.
5.3 Delivery Method: Images will be delivered via online gallery.
5.4 Storage: Images will be stored for 1 year after delivery. It is the Client’s responsibility to back up their images.
6. Copyright and Usage
6.1 Copyright: The Photographer retains copyright over all images.
6.2 Client Usage: The Client is granted a license for personal use, including printing and sharing images on social media (using the credit: Andrea Mariño Photography). Commercial use is prohibited without prior written consent.
6.3 Promotional Use: The Photographer reserves the right to use images for promotional purposes, including portfolios, social media, and advertising, unless the Client explicitly requests otherwise in writing.
7. Limitations of Liability
7.1 The Photographer will take reasonable care to deliver high-quality images but is not liable for circumstances beyond their control, including but not limited to equipment failure, weather conditions, or unforeseen incidents.
7.2 The Photographer’s liability is limited to the amount paid by the Client.
8. Force Majeure
The Photographer is not responsible for failure to perform due to circumstances beyond their control, such as natural disasters, pandemics, or other emergencies. In such cases, efforts will be made to reschedule or refund payments where possible.
9. Agreement
By booking the Photographer’s services, the Client acknowledges that they have read, understood, and agreed to these terms and conditions. Any changes to this Agreement must be made in writing and signed by both parties.
